1. Acceptance of Terms
By accessing and using this website, you accept and agree to be bound by the terms and provision of this agreement.
2. Use License
Permission is granted to temporarily download one copy of the materials on Confluent Solutions' website for personal, non-commercial transitory viewing only.
3. Disclaimer
The materials on Confluent Solutions' website are provided on an 'as is' basis. Confluent Solutions makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
4. Limitations
In no event shall Confluent Solutions or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Confluent Solutions' website, even if Confluent Solutions or a Confluent Solutions authorized representative has been notified orally or in writing of the possibility of such damage.
5. AI-Generated and Synthetic Media Work
Some services, delivered through Confluent Solutions Studio, produce AI-generated media. This includes original virtual actors and fictional characters, which are wholly fictional and are not based on, named after, or intended to depict any real person, and consent-based avatars, which are stylised likenesses of a real person.
Ownership. Rights in delivered work are assigned as set out in the agreement for that engagement. Unless that agreement says otherwise, original virtual actors, characters, and the reference material behind them remain the property of Confluent Solutions and are licensed to the client for the agreed use. Nothing delivered may be used to train or fine-tune a machine-learning model without our written permission.
Avatars and consent. We create a likeness of a real person only where that person has given explicit consent and written authorization, and only within the limits they set. A client cannot give consent on another person's behalf, including an employee's. The subject may withdraw consent at any time; withdrawal stops new production immediately, while material already published is handled under the agreement in force when it was released. Clients are responsible for ensuring that any subject they introduce to us is willing and able to consent.
Disclosure. AI-generated media carries disclosure obligations that vary by platform and jurisdiction and continue to change. We disclose synthetic media in work we publish ourselves. Where the client publishes or distributes delivered work, the client is responsible for meeting the disclosure and labelling requirements that apply to them, and must not present the work in a way that implies a real person genuinely said or did something they did not.
Limits on what we produce. We will not create material that impersonates a real person without their consent, that depicts a real person endorsing something they have not agreed to endorse, or that is intended to deceive. We may decline or stop work that in our judgement falls into these categories.
